"Microsoft dovrebbe essere tenuta ad implementare gli standard liberi e aperti
del settore in modo trasparente, completo e fedele," è il messaggio di una
lettera della Free Software Foundation Europe (FSFE) al Commissario Europeo
per la Concorrenza Neelie Kroes. Per aiutare a raggiungere questo obiettivo, FSFE
ha offerto il proprio sostegno per un'eventuale indagine antitrust che si baserebbe
sul reclamo presentato da Opera Software contro Microsoft. Il reclamo era dovuto
al comportamento anticompetitivo di Microsoft nel mercato dei browser web.

Questo caso è chiuso e l'interoperabilità ha vinto. La Corte Europea ha
chiarito che le informazioni di interoperabilità non possono essere
tenute segrete; l'accordo dimostra che Microsoft non può in alcun modo
continuare a ostacolare l'interoperabilità in questo contesto. Questo
costituisce un requisito a cui tutti si dovranno adeguare d'ora in poi.

"Il blocco dato dalla dipendenza da un dato fornitore è diventato il problema principale
per le decisioni IT in generale e per l'adozione del Software Libero in particolare.
Distorce il mercato e nega alle soluzioni di Software Libero un'equa concorrenza basata sui meriti.
Il problema è che molti lock-in sono invisibili, ad esempio la dipendenza da protocolli proprietari
od il bisogno di usare certi formati di documenti. Certified Open rende questo lock-in visibile
e permette agli utenti di misurare la loro dipendenza".

"Microsoft non si può più considerare al di sopra della legge" dice
Georg Greve, presidente della Free Software Foundation Europe (FSFE).
"Microsoft è riuscita a rinviare questa giornata per quasi dieci anni,
usando le stesse tattiche che hanno fatto deragliare le indagini
antitrust in altre parti del mondo, inclusi gli Stati Uniti. Ma grazie
alla perseveranza e all'eccellente lavoro della Commissione Europea, in
Europa queste tattiche hanno fallito".

The terms of the GNU GPL licence have been confirmed as binding
once again, with a German court ruling that Skype was failing
to uphold its obligations as a distributor. FSFE wants to help
other vendors understand their GNU GPL obligations.

Free Software Foundation Europe (FSFE) has always helped the community
through providing pro bono advice, and through this has discovered
that businesses often require additional personal assistance. For
this reason, FSFE is offering businesses a chance to get individual
consultancy regarding Free Software issues at its Zurich, Switzerland
office.

di consultazione e discussione pubblica. La versione 3 fornisce

Six years after its start in 2001, the Free Software Foundation Europe
(FSFE) has now grown into an organisation of 9 employees equalling 6.7
full-time staff plus two interns. The European Core Team is fast
approaching 30 people and there are active people in more than nine
European countries. This report will try to summarise some of the key
milestones of the past two years of activity.

Le seguenti sei domande si riferiscono alla richiesta di accettazione
del formato ECMA/MS-OOXML come standard IEC/ISO. Un ente di
standardizzazione nazionale, a meno che non abbia risposte convincenti
per tutte queste domande, dovrebbe votare no in sede IEC/ISO e
richiedere che Microsoft incorpori il suo lavoro su MS-OOXML
nell'ISO/IEC 26300:2006 (Open Document Format).

violazioni di brevetti da parte del Software Libero, in un recente
articolo di Fortune.

La FSFE critica la proposta della "seconda Intellectual Property Rights Enforcement
Directive" (IPRED2) perché introduce elementi di criminalizzazione in
diverse aree legislative e per la superficiale descrizione delle fattispecie
di reato, che includono 'il tentativo, la complicità e l'istigazione'. Il
testo proposto criminalizza questi comportamenti in violazione di leggi
molto diverse, come quelle che regolano il diritto d'autore, i marchi e i
brevetti.

La Free Software Foundation Europe (FSFE) è impegnata con esperti legali
di tutta Europa nel rafforzare la solidità legale del Software Libero,
ed è convinta che sia sempre più importante poter trovare supporto
legale professionale, man mano che la comunità del Software Libero
matura. Per questo motivo, la FSFE ha introdotto delle nuove linee guida per
individuare esperti legali nei vari paesi.

Today FSFE has released the Fiduciary Licence Agreement (FLA) under the
terms of the GNU Free Documentation Licence (GFDL) and the Creative
Commons Attribution/Share-alike (CC by-sa) licence. The FLA is a
copyright assignment that allows Free Software projects to bundle their
copyright in a single organisation or person. It enables projects to
ensure their legal maintainability and can be used to either assign
copyright to FSFE's Fiduciary Program or to assign the rights to
another organisation set up by the project team itself.

FSFE considers this a unique opportunity: With the release of Vista,
users will need to upgrade to a new operating system that will feel
different and require some time to get used to its functionality. The
same is true for any modern GNU/Linux distribution. It is about the
same investment in effort, but it will give you control over your own
data.

The OpenSwarm Project will be protected by FSFE's Freedom Task Force
(FTF). Shane Coughlan, FTF Coordinator, explains "The Freedom Task
Force is here to help strengthen the legal foundation of the Free
Software eco-system. The Fiduciary licence Agreement is part of this.
It provides a clear way for projects to consolidate their copyright.
In the case of OpenSwarm, FSFE is acting a legal guardian for the
project and ensuring that the developers can focus on maturing an
exciting development platform."

20 years of practice, Stallman also entertains while telling the
story.
