Historically, Microsoft has used software patents to slow down Free Software adoption in businesses and public administration, by claiming patent infringement of important Free Software components and taking billions of dollars from Free Software re-distributors. Following a more than a decade long tradition, the FSFE once again led its annual Free Software Legal and Licensing Workshop (LLW) in Barcelona, Spain, as a meeting point for world-leading legal experts to debate over issues and best practices surrounding Free Software licences. This year we decided to bring the event back to its roots and to emphasise the "Workshop" part in its original title. On March 19, the Free Software Foundation Europe together with OpenMedia, jointly delivered a petition signed by more than 11.000 individuals, who ask European politicians to save internet from the irreversible dangerous impact of the ongoing copyright reform, and in particular Article 13, which imposes preventive blocking of online code repositories. These signatures were addressed to the EU co-legislators: the European Parliament and the Council of the European Union, and received by MEP Julia Reda, the shadow rapporteur in the European Parliament's Committee on Legal Affairs (JURI) which drives the main parliamentary effort in the current copyright reform.  Read...

With the FSFE's Public Money? Public Code! campaign not only do we demand that code paid for by the people should be available to the people. We also highlight good examples of public code so other decision makers can learn from it. One very good example is Article 68 and Article 69 of the "Codice Amministrazione Digitale", an Italian law requiring public administrations inside Italy to prefer internally made solutions and Free Software solutions over proprietary ones. In addition, these administrations have the duty to share the source code and documentation of any software developed with public money. The FSFE's Fiduciary License Agreement (FLA) was initially introduced in 2002, to address the challenge of managing rights and content within a Free Software project over long periods of time. Digital services offered and used by our public administrations are part of the critical infrastructure of 21st century democratic nations. Due to restrictive software licences, however, many public bodies do not have full control over their digital infrastructure. Although publishing publicly funded software under a free licence generates great benefits for governments and civil society, policy makers are still reluctant to improve legislation in this area. It is time to change this. Although it is still emerging, Open Science receives more and more strategic importance for decision-makers. In the eyes of financial ministers of the European Union, Open Science produces and uses a lot of Open Data, which in turn has the potential for big economic benefits. The "European Cloud Initiative", for example, is part of the European Commission's strategy for Open Science, intended for building a "competitive data and knowledge economy in Europe". It aims at strengthening Europe's position in data-driven innovation and is thus considered to become an important part of the European Digital Single Market. Ο στόχος του πιλοτικού προγράμματος "Ελεύθερος και Ανοιχτού Κώδικα Έλεγχος Ασφαλείας" (FOSSA) είναι να αυξήσει την ασφάλεια του Ελεύθερου Λογισμικού, που χρησιμοποιείται από τα Ευρωπαϊκούς θεσμούς. Το FSFE παρακολουθεί το συγκεκριμένο project από το 2014. Πρόσφατα, η Ευρωπαϊκή Επιτροπή δημοσίευσε τα πρώτα παραδοτέα στοιχεία, που βασίζονται σε συνεντεύξεις με τους ενδιαφερόμενους φορείς . Ενώ το FSFE στηρίζει απόλυτα αυτή την Ευρωπαϊκή πρωτοβουλία, η εφαρμογή του προγράμματους μας δημιουργεί προβληματισμούς. Η πρώτη ανάλυση της FOSSA παραμερίζει την κατανόηση του Ελεύθερου Λογισμικού, περιλαμβάνει πολλά πραγματικά σφάλματα, ενώ βασίστηκε σε γενικές συνεντεύξεις φτωχού περιεχομένου. Το FSFE προσέφερε στην Ευρωπαϊκή Επιτροπή την δική του συνεισφορά όσον αφορά στην τρέχουσα αναθεώρηση του Πλαισίου Ευρωπαϊκής Διαλειτουργικότητας (European Interoperability Framework - EIF). Στόχος του EIF είναι η προώθηση ενισχυμένης διαλειτουργικότητας στο δημόσιο τομέα της ΕΕ, και βρίσκεται προς το παρόν στη φάσης της τρίτης του αναθεώρησης από το 2004. Ενώ στο σχέδιο του δείχνει να προτιμά τα Ανοιχτά Πρότυπα για την διάδοση δημόσιων υπηρεσιών, προωθεί βλαβερούς FRAND (συντόμευση για το "fair, reasonable and non-discriminatory", δηλαδή "δίκαιους, αιτιολογημένους και χωρίς διακρίσεις) όρους για τα πρότυπα. Πρακτικά, αυτοί είναι άκρως μη-ανταγωνιστικοί και ακατάλληλοι όχι μόνο για το Ελεύθερο Λογισμικό αλλά για όλον τον τομέα του λογισμικού γενικότερα. Επιπρόσθετα, το σχέδιο αγνοεί την αποδεδειγμένη σχέση μεταξύ διαλειτουργικότητας και Ελεύθερου Λογισμικού: πολλά εθνικά πλαίσια ρητώς απαιτούν οι εθνικές τους υπηρεσίες να στηρίζονται σε Ελεύθερο Λογισμικό. Το FSFE μαζί με άλλες 72 οργανώσεις υπέγραψε την επιστολή προς τους νομοθέτες για τις τηλεπικοινωνίες στην Ευρώπη υποστηρίζοντας τις ρυθμίσεις για την ουδετερότητα του διαδικτύου στα πλαίσια των διαπραγματεύσεων που βρίσκονται σε εξέλιξη για τις κατευθυντήριες γραμμές σχετικά με την εφαρμογή του πρόσφατα ρυθμισμένου Κανονισμού 2015/212. We published our position on the Radio Equipment Directive 2014/53/EU (adopted in May 2014) that demands from device manufacturers to check each device software's compliance. At first sight, this may sound reasonable but it has highly negative implications on user rights and Free Software, fair competition, innovation, environment, and volunteering – mostly without large benefits for security. The directive needs to be implemented in member states before 13 June 2016. Στη φετινή Γενική Συνέλευση στο Βουκουρέστι, το Ευρωπαϊκό Ίδρυμα Ελεύθερου Λογισμικού (FSFE) εξέλεξε τη νέα ηγετική του ομάδα για τα επόμενα δύο χρόνια. Nowadays we use online services for everything and increasingly provide our data to them. However we also lose the control of our own data more than ever. Together with other organisations FSFE supports the publication of the User Data Manifesto 2.0 which promotes users' basic rights to control their data while using online services. According to the manifesto, users must control the access to their data, they have to know if their data is stored by the online services, and they have to be able to freely choose a platform without being forced to vendor lock-in. The manifesto is a good starting point for the debate about users' rights online, and FSFE looks forward to other organisations joining the effort to stand for online services that respect users' fundamental rights.  Read...

Από τα μισά της χρονιάς, ο πρώτος και ο δεύτερος Δήμαρχος προκάλεσαν σύγχυση αναφορικά με τη μελλοντική στρατηγική IT του Μονάχου. Αμφότεροι οι δήμαρχοι έκαναν αρνητικά σχόλια για το Ελεύθερο Λογισμικό απαντώντας στις ερωτήσεις μας προς τους υποψηφίους, πριν τις εκλογές του Μαρτίου (στα Γερμανικά). Αν μια από αυτές τις ελευθερίες λείπει, τότε είναι δύσκολη η διατήρηση και των υπολοίπων. Ως κοινωνία, είναι σημαντικό να υπερασπισθούμε αυτές τις ελευθερίες, ειδικά υπό το φως των ριζικών αλλαγών όπως, για παράδειγμα, της εισαγωγής των υπολογιστών παντού. Αυτές οι αλλαγές μπορούν να απειλήσον τις παλιές ελευθερίες, αλλά μπορεί και να δημιουργήσουν ανάγκη για νέες. Άρα, η ελευθερία του λογισμικού είναι τώρα κομβικής σημασίας για τη διανομή και την ισορροπία ισχύος στην κοινωνία. Πιστεύουμε ότι τα ιδιοκτησιακά πρότυπα και τα διπλώματα ευρεσιτεχνίας (πατέντες) λογισμικού είναι εμπόδια για την υιοθέτηση Ελεύθερου Λογισμικού. Περισσότεροι δημόσιοι οργανισμοί που χρησιμοποιούν Ελεύθερο Λογισμικό σημαίνει περισσότερα χρήματα για την ανάπτυξη Ελεύθερου Λογισμικού και λιγοτερα προβλήματα για τους πολίτες που χρησιμοποιούν Ελεύθερο Λογισμικό στις επικοινωνίες τους με τις Αρχές. Τον Ιανουάριο η Ιταλική κυβέρνηση κατέστησε το Ελεύθερο Λογισμικό προεπιλογή για τις δημόσιες υπηρεσίες. Το Ιταλικό Ψηφιακό Πρακτορείο (Italian Digital Agency) εξέδωσε νέους κανόνες που ορίζουν ότι όλοι οι κυβερνητικοί οργανισμοί της χώρας πρέπει να λαμβάνουν υπόψη τους το Ελεύθερο Λογισμικό πριν προβούν σε αγορά αδειών χρήσης για ιδιοκτησιακά προγράμματα. Ο κανόνας, ο οποίος ετέθη σε συζήτηση επί πάνω από ένα έτος, τώρα πλέον επιβεβαιώθηκε. Το 2005 αρχίσαμε να δίνουμε κρυπτογραφημένες κάρτες σε όσους μας έκαναν μια δωρεά και γράφτηκαν ως Μέλη (Fellow) του FSFE. Πιστεύουμε ότι είναι σημαντικό να υπενθυμίζουμε στους ανθρώπους τα εργαλεία Ελεύθερου Λογισμικού για την κρυπτογράφηση των επικοινωνιών μας. Πέραν αυτού, στο FSFE, από την ίδρυσή μας το 2001, εξηγούμε ότι εκείνα τα 40 ψηφία πάνω στις εταιρικές μας κάρτες έχουν να κάνουν με την κρυπτογράφηση και γιατί αυτό είναι σημαντικό. 8 χρόνια αργότερα, το θέμα της κρυπτογράφησης αναδείχθηκε στα ΜΜΕ, και τώρα αναφέρεται σε όλες τις Ευρωπαϊκές εφημερίδες. Το F-Droid είναι ένα project που προσφέρει εφαρμογές Ελεύθερου Λογισμικού για το Android με ένα σύστημα αποθετηρίου, το οποίο μοιάζει πολύ με τα συστήματα πακεταρίσματος των διανομών του GNU/Linux. Αυτό διαφέρει από άλλες αγορές εφαρμογών για κινητά, σαν το Google Play, ή το AppStore της Apple, αφού τόσο το λογισμικό από την πλευρά του πελάτη, όσο και του διακομιστή, σέβονται τις ελευθερίες σας και δεν σας αναγκάζουν να εγγραφείτε σε έναν λογαριασμό για να τα χρησιμοποιήσετε. Οι ρυθμίσεις του F-Droid σέβονται την ιδιωτικότητά σας: αν και μπορείτε να τις ενεργοποιήσετε, από προεπιλογή δεν δείχνουν προγράμματα τα οποία 1) προβάλλουν διαφημίσεις, 2) παρακολουθούν και υποβάλλουν αναφορές για την δραστηριότητά σας, προωθούν 3) μη-ελεύθερα πρόσθετα ή 4) μη-ελεύθερες υπηρεσίες δικτύου, ή 5) εξαρτώνται από άλλες μη-ελεύθερες εφαρμογές. In April the German Parliament (the 'Bundestag') has introduced a joint motion against software patents. It urges the German government to take steps to limit the granting of patents on computer programs. Όπως μπορείτε να διαβάσετε και να δείτε στη φετινή αναφορά, η Ημέρα Ελευθερίας Εγγράφων 2012 εορτάστηκε με 54 εκδηλώσεις σε 23 χώρες και σε 19 γλώσσες. Ήταν η μεγαλύτερη DFD στην ιστορία με πάνω από 26 ομιλίες, πάνω από 6 βραβεία για τα Ανοιχτά Πρότυπα, πολλές άλλες εκδηλώσεις και η κάλυψη από τον τύπο να μετράει σχεδόν εκατό άρθρα. Το FSFE έκανε τον συντονισμό ανάμεσα σε όλες τις διαφορετικές εκδηλώσεις, βράβευσε πολλούς οργανισμούς και στη Γερμανία επικοινώνησε γραπτά με πάνω από 370 και τηλεφωνικά με πάνω από 170 πολιτικούς σχετικά με τα Ανοιχτά Πρότυπα. Πολλοί από τους πολιτικούς αυτούς, από ένα φάσμα πολιτικών κομμάτων, δραστηριοποιήθηκαν για την DFD. Το FSFE επίσης έστειλε 100 ενημερωτικά πακέτα μαζί με χειροπέδες με προτάσεις σε ανθρώπους που περιλαμβάνουν πολλούς πολιτικούς, Εκτελεστικούς Διευθυντές και τον Πάπα. Ένα «έργο» είναι πάντα προσωρινό, με τη στενή έννοια του όρου. Αντίθετα κάποια άτομα από το Ελεύθερο Λογισμικό χρησιμοποιούν το «έργο» όταν αναφέρονται σε πρωτοβουλίες που εκτείνονται σε βάθος χρόνου. Και ο εκδότης σας έτσι έκανε, μέχρι που ο Bernhard Reiter τον έπεισε να χρησιμοποιεί διαφορετικούς όρους για ανθρώπους, για το αποτέλεσμα που δημιουργούν και για προσωρινού συντονισμού ενέργειες. «7500 νεκροί πέρυσι, 100 ανά ημέρα». Αυτό διάβασε ο εκδότης του ενημερωτικού δελτίου στην οθόνη ειδήσεων του μετρό στο Βερολίνο. Συζητώντας με την εθελόντρια της DFD Julia Fuchs τι πάει στραβά -- η ικανότητα ανάγνωσης του εκδότη σας, οι βασικές του γνώσεις στα μαθηματικά ή το πρακτορείο ειδήσεων -- κάτι διαφορετικό αναδύθηκε: η δράση μας FreeYourAndroid.org! Τα έξυπνα κινητά τηλέφωνα είναι μικροί υπολογιστές που κουβαλάμε στην τσέπη μας συνεχώς. Δυστυχώς, τα περισσότερα δεν ελέγχονται από εμάς, αλλά από τους κατασκευαστές και τους χειριστές τους. What would you do with a monopolist, who uses his dominant position in one area to create monopolies in other areas as well? The European Commission has decided in 2004 that Microsoft has to provide competitors with information how to connect a workgroup server with computers running Microsoft Windows. Since the main competitor to Microsoft’s workgroup server is the Free Software Samba project, the Commission made it clear that Microsoft had to release interoperability information in a way that is compatible with Free Software licenses like the GNU GPL. That is why after the intensive work of the past year to build up and grow the Freedom Task Force, work on antitrust and OOXML issues, and various other activities, FSFE had some of them as well. The last month of 2007 was pretty exciting, with the biggest news being the release of interoperability information by Microsoft in connection with the European antitrust case. The SAMBA project has arranged full access to specifications necessary for communication competitive alternatives to Microsoft's proprietary products. Of course, this does not mean that Microsoft's monopolistic behaviour has been resolved. A new antitrust case may be undertaken after complaints by Opera Software that Microsoft has willfully distorted the web browser marketplace. It's also important to note that this does not in any way solve the problem with patents on software. Such patents are still being granted by the European Patent Office (EPO) in violation of current law, and the FSFE is encouraging the European Commission to take actions to permanently abolish patents on software, both in theory and practice.  Read...
